Can I build an accessory dwelling unit?

Likely yes, subject to LDO Sec. 9-1255(m)(1). An accessory dwelling unit (ADU) is a permitted accessory use in most residential and mixed-use districts under the Sec. 9-1254 Permitted Use Table read during this review. As of the Town's LDO Amendment #26 (2024), an ADU may be rented out separately from the principal structure, unlike an ordinary accessory structure (shed, garage, or similar), which cannot be rented, leased, or sold separately from the principal home. A building permit is required for the ADU as an accessory structure. The ADU must meet the applicable district's setback requirements under Article G, the same as any accessory structure (Sec. 9-1255(m)(1)(F)), and requires 1 off-street parking space per unit. The exact maximum-size cap (Sec. 9-1255(m)(1)(C)) and any height limit specific to the ADU itself were not independently confirmed from the primary section text this session and are review-gated in this pack; confirm those figures directly with LDO Sec. 9-1255(m)(1) or the Planning Department at 919-552-1429 before building.
