Can I build a shed or detached garage?
Yes, subject to a building permit and LDO Sec. 9-1255(p)(1) and Sec. 9-1302. Inside Town corporate limits, a maximum of 3 accessory structures are permitted per zoning lot on lots of 0.3 acres or larger (2 on smaller lots, or on lots zoned Residential Mixed-Use); there is no cap in the ETJ. Total accessory structure area is capped at 10 percent of lot area on lots under 1 acre, or 5 percent on lots 1 acre or larger (500 square feet flat cap in the RMU district). Most accessory structures need a minimum 8-foot setback, though the exact setback can vary by structure type under Sec. 9-1302(a) through (d). A shed, garage, or similar accessory structure cannot be rented, leased, or sold separately from the principal home, and cannot be used for a commercial or home occupation purpose (this restriction does not apply to a permitted Accessory Dwelling Unit). Confirm your district, lot size, and whether you are inside Town limits or the ETJ with the Planning Department at 919-552-1429 before building.
