What are the deadlines to appeal a zoning decision in Royal Oak?
Two deadlines matter, and both are short. An administrative appeal of the Zoning Administrator's decision must be filed with the Zoning Board of Appeals within 30 days of the decision (§ 770-124C, § 770-125B). If you then disagree with the ZBA's ruling, a judicial appeal to circuit court must be filed within 21 days of the ZBA decision (§ 770-125L).
Other timing rules in the same article:
- ZBA orders are valid for 1 year (§ 770-125K)
- The ZBA cannot hear special land use or PUD appeals unless the Planning Commission authorizes it (§ 770-124E)
- Sign appeals and variances go to the Planning Commission, not the ZBA (City Code § 607-16)
Missing a deadline generally ends the appeal, so calendar both dates from the day the decision issues. For filing procedures, contact the Planning Division at 248-246-3280.
