Dimensional (non-use) variances come from the Zoning Board of Appeals under the practical difficulty standard: strict compliance must unreasonably prevent use of the property or be unnecessarily burdensome, a lesser variance must not suffice, the circumstances must be unique to the property, and the problem cannot be self-created (Section 30.02.C.6.a). A majority vote grants a non-use variance; a use variance needs five concurring votes, an unnecessary hardship showing, and a prior written determination or failed rezoning attempt (Section 30.02.C.6.b).
Hearings require published and mailed notice to owners within 300 feet at least 15 days ahead (Section 28.20). A granted variance lapses if no permit application follows within one year, with one possible six month extension (Section 30.02.E). Fence variances go to the separate Board of Ordinance Appeals under Chapter 19 (19-11), and sign relief can start at the Administrative Review Board (Section 28.13.L.11).
