Permitted uses in Royal Oak, MI

1F — One-Family Residential

Permitted by right in One-Family Residential (§ 770-34B): one single-family dwelling per lot, parks, home occupations (§ 770-25), public and private K-12 schools, museums and libraries, accessory buildings (§ 770-22), family day-care homes (§ 770-26), and state-licensed adult and child foster care family homes and small group homes for six or fewer residents.

A use is permitted by right only if it is listed. Unlisted-use determinations are made by the Zoning Administrator (§ 770-21A(4)). Two-family dwellings are not permitted in this district.

1FL — One-Family Large Lot Residential

One single-family dwelling per lot is the principal permitted use (§ 770-21E(2)). The district's full by-right list is in § 770-35B and follows the city's one-family pattern, which includes home occupations (§ 770-25), accessory buildings (§ 770-22), and family day-care homes (§ 770-26).

A use is permitted by right only if it is listed. Unlisted-use determinations are made by the Zoning Administrator (§ 770-21A(4)). Two-family dwellings are not permitted in this district.

2F — Two-Family Residential

Two-family dwellings are permitted by right in this district, which is what sets it apart from the one-family zones (§ 770-36B). The district's full by-right list is in § 770-36B and follows the city's residential pattern, which includes home occupations (§ 770-25), accessory buildings (§ 770-22), and family day-care homes (§ 770-26).

MF — Multiple-Family Residential

Multiple-Family Residential is the district for apartments and other multiple-family dwellings; the district's use lists are in § 770-37. A use is permitted by right only if it is listed, and unlisted-use determinations are made by the Zoning Administrator (§ 770-21A(4)).

Each unit has a minimum living space (§ 770-23C):

  • Efficiency: 250 square feet
  • One bedroom: 450 square feet
  • Two bedrooms: 600 square feet
  • Three bedrooms: 750 square feet

OS — Office Service

Office Service is the city's office and service district; its by-right and special land use lists are in § 770-38. A use is permitted by right only if it is listed, and unlisted-use determinations are made by the Zoning Administrator (§ 770-21A(4)). Special land uses are decided by the Planning Commission after a public hearing (§ 770-11).

NB — Neighborhood Business

Neighborhood Business allows retail and personal services by right, along with restaurants (§ 770-39). Serving alcohol requires a plan of operation approved by the City Commission (§ 770-52B).

Special land uses, decided by the Planning Commission after a public hearing (§ 770-11), include upper-floor dwellings and drive-throughs (§ 770-39).

NB2 — Neighborhood Business II

Neighborhood Business II is narrower than Neighborhood Business. Small retail of 2,500 square feet or less is permitted by right. Restaurants are a special land use, decided by the Planning Commission after a public hearing (§ 770-40; § 770-11).

CBD — Central Business District

In the Central Business District, dwellings above the first floor are permitted by right, as long as the ground floor holds a permitted use other than parking (§ 770-42). Ground-floor dwellings are a special land use, decided by the Planning Commission after a public hearing (§ 770-11).

No off-street parking is required in the CBD except for residential, hotel, and institutional uses (§ 770-106E).

RB — Regional Business

Regional Business is built for large regional commercial development; its by-right and special land use lists are in § 770-43. A use is permitted by right only if it is listed, and unlisted-use determinations are made by the Zoning Administrator (§ 770-21A(4)).

GB — General Business

General Business builds on the Neighborhood Business uses and adds the more intensive commercial uses as special land uses (§ 770-41): vehicle dealers, filling stations, and car washes (§§ 770-63 to 770-67), adult businesses (§ 770-76), marihuana retailers (§ 770-52.1), hotels, and large-scale retail (§ 770-82).

Most special land uses are decided by the Planning Commission after a public hearing (§ 770-11). Marihuana establishments and alcohol plans of operation go to the City Commission after a Planning Commission recommendation (§ 770-52.1; § 770-52B).

GI — General Industrial

General Industrial hosts the city's industrial uses; its by-right and special land use lists are in § 770-44. A use is permitted by right only if it is listed, and unlisted-use determinations are made by the Zoning Administrator (§ 770-21A(4)).

MU1 — Mixed Use 1

Mixed Use 1 allows all permitted and special land uses from the One-Family Residential district, subject to that district's standards, plus two-family dwellings, senior housing, attached single-family dwellings, and the permitted uses from Office Service by right (§ 770-45). Office Service special land uses remain special land uses in MU1.

Multiple-family housing is a special land use, decided by the Planning Commission after a public hearing (§ 770-11), with a density bonus of up to 100 percent for sites at least 150 feet from established residential (§ 770-45).

MU2 — Mixed Use 2

Mixed Use 2 allows the MU1 uses, adds Neighborhood Business uses, and permits multiple-family dwellings by right, subject to the Multiple-Family Residential standards (§ 770-46). Special land uses are the Neighborhood Business special land uses, except drive-through facilities are prohibited (§ 770-46; § 770-11).

Drive-throughs are expressly prohibited in Mixed Use 2 (§ 770-46).

PUD — Planned Unit Development

Planned Unit Development is a negotiated district. Its uses and standards are set through the PUD approval itself rather than a fixed use list (§ 770-47; §§ 770-98 to 770-103). A PUD is a rezoning: the City Commission decides it after a Planning Commission recommendation (§ 770-98A). The ZBA cannot hear PUD appeals unless the Planning Commission authorizes it (§ 770-124E).

SR — Special Redevelopment

Special Redevelopment is a district for designated redevelopment sites. Section 770-48 creates the district and points special redevelopment projects to § 770-87 for the substantive procedure and standards.
