SHD-RO — Surprise Heritage District - Residential Overlay

Within the SHD Residential Overlay, a 'Cottage Industry' use is available as a more flexible alternative to the citywide Home Occupation standard (Sec. 106-10.23): hours of operation 8am to 8pm, up to 50 percent of the home may be used for the business, a small number of employees is allowed, some activities may occur outside the house if screened from view, and small signage identifying the business is permitted. This is broader than the standard Home Occupation rule; confirm current eligibility and any registration step with Planning and Zoning (623-222-3000).

All districts

Home occupation is a permitted accessory use in all residential zoning districts, subject to a city business license and detailed standards (Sec. 106-10.23). Use must occupy no more than 50 percent of the residence's gross floor area, or 400 square feet of a garage/accessory structure. Employees are limited to residents, immediate family, or up to 2 non-resident/non-family individuals. Patron/student/customer contact hours are limited to 8:00 a.m. to 8:00 p.m., unless expanded by a conditional use permit. No exterior displays, outdoor storage visible from the street, semi-tractor/trailer delivery or receipt, on-site retailing or wholesaling, or on-site advertising (other than a Class I temporary sign during business hours) is allowed. Certain uses (animal clinics/kennels, dance/gymnastic instruction, medical/dental/therapy offices, vehicle repair, restaurants, private schools, banks/payday lending, and others) are never permitted as home occupations.
